# Poly Haven API Terms of Service

While our 3D assets themselves are published under the CC0 license, and the code for this API is licensed as AGPL, access to this API through our servers (api.polyhaven.com) is covered separately by these terms of service.

1. Acceptance of Terms

By accessing and using the Poly Haven Public API ("the API", available at api.polyhaven.com), you agree to comply with the terms and conditions outlined in this Terms of Service agreement ("ToS"). If you do not agree to these terms, you are not permitted to use the API.

2. API Use and Restrictions

2.1. Free for Everyone: The API is free to access and use by anyone - individuals, organizations, and companies alike - for any purpose, including commercial use, at no charge. There is no non-commercial restriction and no commercial license requirement for basic API access.

2.2. Permitted Use: Users are allowed to access and utilize the API to obtain data and assets hosted on Poly Haven, and to build on that data in their own software, websites, services, or products, including for commercial and for-profit purposes.

2.3. No Commercial Upsell: Poly Haven will never require payment, a license, or a key in order to access the API or the data it serves. Using the API to generate revenue, directly or indirectly, is explicitly permitted and does not require any special agreement with Poly Haven.

2.4. Requirements: When using the API inside your software, website or service, all API calls must be made with a unique "Referer" header or user-agent that matches your software name, such that we can track all the requests from your app together.

2.5. Attribution: This clause applies only to use of the live API service - it does not apply to the CC0 assets themselves once downloaded or self-hosted. CC0 assets carry no attribution requirement whatsoever, now or ever. However, if you use the live API inside your software, website, or service to surface Poly Haven content, you must make it clear to your users where that content comes from. Any reasonably visible credit is acceptable for this - for example, a label within your interface (a title, menu item, or button that names Poly Haven), or, where that isn't a good fit, a "Powered by Poly Haven" credit displayed near the content. This credit must be lightweight (a simple credit line or logo) and must not state or imply that your product is made by, owned by, or officially endorsed by Poly Haven.

2.6. Acceptable Use Policy: Engaging in any activity that disrupts, interferes with, or degrades the performance of the API or the experience of other users is prohibited. This includes, but is not limited to, denial-of-service attacks, spamming, or any other form of malicious behavior.

2.7. Optional Support for Production Use: Companies whose products or services depend heavily on the API in production may optionally choose to directly fund that usage through a bespoke arrangement with Poly Haven, which can include things like a signed Provenance Attestation manifest or a Bulk Snapshot. This is entirely optional directed funding for the commons, not a requirement to use the API, and it does not change any of the terms above. 3. Ownership and Intellectual Property

3.1. Poly Haven retains all rights, title, and interest in the API, including all associated data and content.

3.2. Users acknowledge that the data provided through the API are subject to copyright, trademark, and other intellectual property rights held by Poly Haven or their respective owners.

4. API Availability and Modifications

4.1. Poly Haven reserves the right to modify, suspend, or terminate the API or any part of it, temporarily or permanently, without prior notice.

4.2. Poly Haven is not liable for any interruptions, errors, or unavailability of the API. The API is provided on an "as available" basis, without any service-level or uptime guarantee.

5. Limitation of Liability

5.1. Poly Haven shall not be held liable for any direct, indirect, incidental, consequential, or special damages arising out of or related to the use or inability to use the API.

5.2. Poly Haven makes no warranties or representations regarding the accuracy, completeness, or reliability of the API data or assets.

6. Indemnification

Users agree to indemnify, defend, and hold harmless Poly Haven and its affiliates, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorney fees, arising out of or related to the use of the API in violation of this ToS.

7. Governing Law

This ToS shall be governed by and construed in accordance with the laws of South Africa, without regard to its conflict of laws principles.

8. Changes to the Terms

Poly Haven reserves the right to update or modify this ToS at any time without prior notice. Users are encouraged to review the ToS periodically for any changes.
